On February 28th, 2019, the DCSO took a report of a theft from a vehicle that was unoccupied and stuck in a ditch.  The vehicle was stuck in the 2000 block of 140th Street.  The owner noticed that their wallet and a spotting scope were missing.

Upon further investigation from surveillance videos, a vehicle of interest was determined.  On March 7th, 2019, the vehicle of interest was spotted in Spirit Lake near the intersection of Hill Avenue and 37th Street.  The Spirit Lake Police Department initiated a traffic stop on the vehicle for moving violations.  The driver was identified as Mark Westlake (57).  Westlake was arrested for no valid driver’s license, no insurance, driving on the wrong side of a two-way highway, and fail to use seatbelt.  A wallet that matched the description was seen in plain view.

The DCSO executed a search warrant on the vehicle.  The wallet was positively identified as the stolen wallet from the vehicle in the ditch.  The DCSO also executed a search warrant in Lake Park on a storage unit that Westlake was renting.  The stolen spotting scope was located in the storage unit.

Westlake was additionally charged with unauthorized credit card use, theft in the 3rd degree, burglary in the 3rd degree, possession of stolen property, possession of a controlled substance (methamphetamine), and possession of drug paraphernalia.  Westlake is currently being held on a $6,000 cash/surety bond.

The DCSO was assisted by the Spirit Lake Police Department and the Lake Park Police Department.

All persons are presumed innocent until proven guilty in a court of law.
